Liability Waiver

Bunker Hill Karate and Fitness, LLC DBA: Prospect Martial Arts (PMA)

This Waiver sets forth the acknowledgment of risk, liability release, and responsibilities as a participant in PMA's martial arts programs, between Bunker Hill Karate and Fitness, LLC DBA: Prospect Martial Arts ( PMA ) and {name} or the parent or legal guardian of {name} ( Member ), governed by the laws of the State of Connecticut

Fitness & Physical Readiness

• Member represents that they are physically and mentally capable of participating in martial arts training. Member understands that martial arts is a physically demanding activity and accepts responsibility for ensuring their own readiness to participate. PMA recommends consulting a physician before beginning any new physical activity.

Assumption of Risk & Liability Release

• Member acknowledges that martial arts training involves inherent physical risks, including but not limited to muscle strains and sprains, bruising and contusions, joint injuries affecting the knee, shoulder, elbow, wrist, hip, and ankle, impact injuries to the head, face, and body, fractures, ligament and tendon injuries, and in rare cases concussion, spinal injury, or other serious bodily harm. These risks are present in all aspects of training including warm-up, technique practice, drills, sparring, and testing, and exist regardless of the Member's age, fitness level, or experience.

• Member participates in PMA's programs and uses PMA's facilities entirely at their own risk.

• Member voluntarily and knowingly releases, waives, discharges, and holds harmless PMA, its owners, officers, instructors, employees, volunteers, and agents from any and all claims, demands, damages, costs, expenses, or causes of action of any kind arising out of or related to Member's participation in PMA's programs, facilities, or events, including but not limited to claims of negligence, injury, illness, death, or loss of personal property. This release does not apply to injuries or damages resulting from the gross negligence or intentional misconduct of PMA.

Classes, Schedules & Instruction

• PMA determines class schedules, content, and instructor assignments, which may change without notice.

• Participation in events and testing is encouraged but not required. Equipment may be purchased through PMA as needed.

Member Obligations & Conduct

• Member agrees to follow all PMA rules and codes of conduct while on PMA's premises or participating in any PMA-sponsored activity. A full copy of PMA's rules and codes of conduct is available at the front desk at any time and will be provided upon request.

• Non-compliance may result in suspension or termination of membership with no refund for unused services.

• Upon termination, any outstanding balance becomes immediately due.

Photo & Video Consent

• Member agrees that PMA may use Member's photos and videos for promotional purposes, including social media, the PMA website, and print materials.

Governing Disputes

• Any disputes or lawsuits shall be resolved exclusively through the courts of jurisdiction governing Prospect, Connecticut.

Agreement & Signature

Member acknowledges receiving a fully executed copy of this Agreement, understands it is legally binding, and agrees to comply with all financial terms as modified by Connecticut law.
